Real Oviedo, S.A.D., in relation to the Resolution issued on February 19, 2026, by the Sole Judge of Professional Competitions of the RFEF regarding the match corresponding to the 23rd matchday against Rayo Vallecano, wishes to state the following:
1. The resolution recognizes the lack of competence of LaLiga and the invalidity of the suspension, as maintained by Real Oviedo.
The Resolution upholds the claims made by this Club and explicitly states: “The decision to suspend the match adopted by LA LIGA on February 7, 2026, was made by an entity lacking jurisdictional competence, as it lacked legal or regulatory authority to do so, thereby incurring a cause of competitive ineffectiveness due to lack of regulatory authorization.”
Furthermore, the ruling agrees: “To declare the competitive ineffectiveness of the decision to suspend and postpone the match (…) adopted by LA LIGA (…) for having been issued by said entity, lacking regulatory authorization.”
And adds: “To dismiss the request of the National Professional Football League to reject the claims of Real Oviedo, S.A.D. due to the lack of competence of this federative body.”
The Resolution is unequivocal: LaLiga did not have regulatory authority to suspend the match or to unilaterally set a new date, as Oviedo has maintained in the file.
2. The National Court ruling does not grant LaLiga the power to suspend, as maintained by Real Oviedo.
In response to the statement issued by LaLiga, the Resolution thoroughly analyzes the scope of the National Court Judgment of December 18, 2024, and concludes: “It is crucial to highlight what the judgment (…) does not say (…) that LA LIGA is granted the competence to agree on the suspension of matches.”
And explicitly: “The judgment is limited to transferring to LaLiga the subsequent power of rescheduling, once the suspension has been validly decreed by the appropriate authority.”
Therefore, the thesis maintained by LaLiga —according to which the setting of dates would imply suspension— has been legally rejected.
3. Suspending is not organizing: it is a guarantee power, as maintained by Real Oviedo.
The Resolution makes an essential distinction that this Club has been defending since the beginning of the procedure: “The power to suspend a match is very different. This is not a mere organizational function, but an act of authority of a technical-sporting nature.”
And warns of the consequences of accepting LaLiga's thesis: “Accepting LA LIGA's claim would result in a profound and unintended alteration by the legislator of the institutional balance of Spanish football.”
The preventive suspension agreed by LaLiga, moreover, occurred even before the referee team could inspect the field, emptying the technical arbitration power provided for in the regulations of its content.
4. Force majeure was not proven, as maintained by Real Oviedo.
The Resolution also rejects that a cause of force majeure occurred: “This Judge cannot consider sufficiently proven the occurrence of a cause of force majeure in the terms required by the regulations.”
And emphasizes that: “The main cause of the unavailability of the field was not (…) a sudden and inevitable event, but the ordinary course of scheduled works that could not be completed on time.”
Additionally, there is evidence of an alternative field designated by regulation, whose use was not even considered.
5. About LaLiga's statement.
The statement issued by LaLiga claims that the RFEF lacks review competence and that suspension is part of its organizational power. However, the Resolution explicitly states: “The exception contained in Article 46 refers to other bodies within the federative structure (…), not to external entities.”
And concludes that the competence to address the non-celebration corresponds to the federative body: “When a match is not held, this body is competent to address the circumstances that have prevented it.”
Therefore, the current legal framework does not support the extensive interpretation defended by LaLiga.
6. Institutional commitment
Real Oviedo once again thanks the constant support of its fans and acknowledges the work of the Club's Legal Services, whose efforts have led to the declaration of the ineffectiveness of an action contrary to sports regulations, as committed by LaLiga against the Club and its fans.
The Club will continue to defend, before all competent federative, disciplinary, administrative, and judicial bodies, that the full legal consequence of the events must include the declaration of the loss of the match when there is no force majeure and the suspension has been adopted by an incompetent body. All this, without prejudice to the rest of the legal actions that it is entitled to under the law in defense of the legitimate rights and interests of the Club and its fans.
The integrity of the competition, respect for sports legal regulations, and equality among clubs are non-negotiable principles for this entity.
